These 30-Day Inspection Accuracy Guarantee Terms and Conditions (the "Guarantee") are a limited contractual promise from Carify, Inc. ("Carify") to the buyer ("you") who purchased a Carify inspection. The Guarantee assures the accuracy of Carify’s own inspection, and its sole remedy is a refund of the inspection fee. It is not a buy-back, not insurance, and not a vehicle service contract. The Guarantee is part of, and incorporated into, the Carify Terms of Service that you accept at checkout. Capitalized terms are defined below.
1. Definitions
- Report. The standardized, graded A/D/F inspection report Carify issues for your vehicle (the "Vehicle") after a non-invasive inspection by a Carify Verified Inspector.
- Catastrophe. Any of three conditions: (a) a structural-accident (a load-bearing structural member that has been cut, sectioned, replaced, or shows a repair weld over 8 cm or deformation over 1 cm); (b) flood (water-intrusion damage); or (c) fire (heat damage). Bolt-on cosmetic parts (bumpers, fenders, doors, hood, trunk lid) are not structural members.
- Grade A. A Report finding no evidence of any Catastrophe was observed. Only a Grade-A Vehicle is eligible for the Guarantee. Vehicles graded D (confirmed accident) or F (any flood, fire, or suspected catastrophe) are not eligible.
- Reasonably detectable. A condition that would be observable during Carify's standardized, non-invasive inspection (including an undercarriage examination). Professionally concealed conditions that are not reasonably detectable without disassembly are outside the Guarantee.
2. What is covered
Subject to these terms, the Guarantee applies if all of the following are true: (a) your Report graded the Vehicle A; (b) within the claim window you discover, and an independent re-inspection confirms, that the Vehicle was, at the time of the Carify inspection, a structural-accident, flood, or fire Vehicle; and (c) that Catastrophe existed at inspection and was reasonably detectable but is not reflected in your Report.
3. Objective thresholds
- Structural accident: a load-bearing structural member (frame rail, subframe, A/B/C/D pillar, rocker/sill, firewall/cowl, strut tower, floor pan, radiator core support, or trunk floor) has been cut, sectioned, or replaced, or shows a repair weld over 8 cm or deformation over 1 cm.
- Flood: silt, mud, or corrosion consistent with water intrusion present in two or more separate areas (e.g., under carpet/padding, a wiring-harness connector, the spare-tire well, or seat tracks).
- Fire: heat damage, melting, or scorching affecting wiring, structural, or safety systems. Cosmetic-only heat marks are excluded.
4. Eligibility
- The Vehicle was graded A by a current Carify Report.
- The Vehicle is a standard passenger vehicle (no motorcycles, RVs, commercial/fleet vehicles, or vehicles with an already-disclosed branded title).
- You purchased the inspected Vehicle, which bears the same VIN as the Report. The Carify inspection is a pre-purchase inspection, so no separate activation step is required.
- You file any claim within 30 days of the Report date.
- The Guarantee is one-time, non-transferable, and applies to a single Vehicle and a single buyer.
5. Remedy
If a claim is approved, Carify’s sole remedy is a full refund of the inspection fee you paid for the Report. Carify does not repurchase the Vehicle, take title, pay any lienholder, or make any payment based on the Vehicle’s value or any diminished value. This Guarantee has no monetary cap beyond the inspection fee, and it applies to all model years.
6. Exclusions
- Cosmetic or bolt-on items, normal wear, maintenance items, and mechanical failures that are not a Catastrophe.
- Any damage, loss, or condition arising after the Carify inspection (including post-purchase accidents, flooding, or fire).
- Conditions that did not exist at the time of inspection, or that were not reasonably detectable under the non-invasive SOP (e.g., professionally concealed repairs).
- Vehicles graded D or F; vehicles outside the eligibility criteria; misuse, odometer, or title matters outside the three-Catastrophe scope.
- Indirect, incidental, or consequential damages.
7. Claims process
- Notify Carify within the claim window and provide your Report, proof and date of purchase, the VIN, and any supporting photos.
- Carify arranges an independent re-inspection at a neutral Verified Inspector. The independent re-inspection, measured against the Section 3 thresholds, is the arbiter of whether a covered Catastrophe existed at inspection.
- Carify decides the claim within 14 days of the re-inspection and, if approved, completes the refund within 10 business days.
8. Scope, observational language & no warranty
This Guarantee is a limited promise, not a warranty of condition, merchantability, or fitness, and not a certification that the Vehicle is free of defects. The Report reflects a non-invasive, point-in-time, observational inspection. Statements such as "no evidence observed" describe what was observed on the inspection date and are not a guarantee of absolute absence. You remain responsible for your own due diligence.
9. Limitation of liability
For any claim other than an approved refund under this Guarantee, Carify's total liability is limited to the inspection fee you paid. Carify is not liable for indirect, incidental, special, or consequential damages. Nothing here limits liability that cannot be limited by law.
10. How the Guarantee is funded
Carify stands behind this Guarantee directly and funds it from its own reserves. The Guarantee is a limited promise about the accuracy of Carify's inspection, and its sole remedy is a refund of the inspection fee. It is not a buy-back, not a vehicle service contract, and not a separate insurance product.
11. Dispute resolution; governing law
These terms are governed by California law. Disputes are resolved as set out in the Carify Terms of Service, including binding individual arbitration administered by the American Arbitration Association (AAA) and a class-action waiver (subject to any non-waivable rights). Venue: Los Angeles County, California.
12. General
If any provision is unenforceable, the rest remains in effect. Carify may update these terms going forward by posting a new version. The version you accepted at checkout governs your Guarantee. These terms, with the Terms of Service and your order, are the entire agreement on this subject.
