Inspection Report Disclaimer & Scope

1. Purpose and Acceptance

This Inspection Report Disclaimer and Scope Statement (this "Statement") accompanies and forms part of every vehicle inspection report (the "Report") made available by Carify, Inc. ("Carify"). Before you can open a Report, Carify presents this Statement for your agreement. By ordering, accessing, downloading, or relying on a Report, you ("you," "Customer") acknowledge that you have read and agree to this Statement, the Carify Terms of Service, and the Carify Privacy Policy. If you do not agree, do not access or rely on the Report.

2. What the Inspection Is

The Carify inspection is a standardized, non-invasive, point-in-time examination of a used motor vehicle performed by an independent Carify "Verified Inspector." It consists of a visual and electronic (OBD-II) examination, including an underbody examination and a defined set of mandatory evidence photographs, designed primarily to screen for catastrophe-level conditions, namely: (a) major structural / collision damage; (b) flood or water damage; and (c) fire or heat damage, each as defined by Carify's published grading criteria. The Report assigns a condition grade (e.g., A / D / F) reflecting the presence or absence of such catastrophe-level indicators under Carify's defined objective thresholds, together with inspector notes and photographs taken at the time of inspection.

3. What the Inspection Is NOT (Scope Limitations)

You expressly understand and agree that the inspection and the Report:

• are non-invasive, meaning the Verified Inspector does not disassemble, dismantle, or remove components, open sealed systems, or perform extended road testing, dynamometer testing, or any destructive testing;
• are a snapshot as of the date and time of inspection only, and do not describe the vehicle's condition before or after that time;
• are not a guarantee, warranty, or prediction of the vehicle's future condition, reliability, durability, mechanical performance, safety, roadworthiness, or fitness for any purpose;
• are not a comprehensive mechanical inspection and do not detect or disclose every defect, fault, latent condition, prior repair, or future failure;
• do not independently verify title or lien status, odometer accuracy beyond the displayed reading, ownership or accident history, or detect title branding or undisclosed history, except as expressly stated in the Report;
• do not constitute an appraisal, valuation, or a recommendation to purchase or to decline to purchase any vehicle;
• address cosmetic, wear, and routine-maintenance items only to a limited extent and are not intended to catalog every cosmetic flaw.

4. Meaning of the Grade

A grade of "A" indicates only that no catastrophe-level indicators (major structural, flood, or fire damage) were identified under Carify's defined objective thresholds at the time of inspection. A grade of "A" is not a certification that the vehicle is defect-free, free of all prior damage, or free of mechanical problems, and does not warrant any aspect of the vehicle beyond the specific catastrophe categories evaluated. Grades "D" and "F" indicate the findings described in the Report and in Carify's grading criteria.

5. Independent Verified Inspectors

Physical inspections are performed by independent third-party Verified Inspectors. Carify standardizes the inspection methodology, mandatory evidence-photo requirements, and grading, and applies quality-control and anti-fraud measures, but the Verified Inspector performs the physical inspection as an independent contractor, not as Carify's agent or employee.

6. Relationship to the Inspection Accuracy Guarantee

Any inspection-accuracy protection that may apply to an eligible Report is separate from this Statement and is governed exclusively by the Carify Inspection Accuracy Guarantee Terms and Conditions. This Statement does not create, expand, or modify any guarantee right, and nothing in this Statement is itself a service contract, insurance product, or warranty. See Inspection Accuracy Guarantee Terms Section 5 (Remedy).

Publication of Reports. Where the vehicle owner has consented, Carify may publish the inspection report — including the grade, a findings summary, and the inspection photos — published on a permanent, VIN-searchable basis. License plates are covered at the inspection, any individuals are avoided (and an inadvertently-captured person can be removed on request), and location/EXIF metadata is removed from published images. Published reports may show the Verified Inspector's identity (so buyers can see where the car was inspected). No ordering-user or vehicle-owner personal information is published. Published data is observational, point-in-time, and not a warranty of the vehicle; it is governed by the Terms of Service, including the Data Dispute & Correction process.

7. No Warranties

Except as expressly and specifically stated in a separate signed written agreement, the Report is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including, to the fullest extent permitted by applicable law, the implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing in this Statement waives any right or warranty that cannot lawfully be waived.

8. Customer's Independent Judgment

The Report is provided for your informational use to assist your own independent evaluation. You remain solely responsible for your purchase decision. Carify recommends that you obtain any additional inspection, specialist evaluation, title and history check, or test drive you consider appropriate before purchasing any vehicle.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CARIFY'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE INSPECTION OR THE REPORT IS LIMITED AS SET FORTH IN THE CARIFY TERMS OF SERVICE. THIS DOES NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW.

10. Incorporation and Governing Terms

This Statement is incorporated into and governed by the Carify Terms of Service. If there is a conflict, the Inspection Accuracy Guarantee Terms control on matters specific to that Guarantee, and the Terms of Service control on all other matters. Governing law, venue, and any arbitration or class-action-waiver provisions are as set forth in the Terms of Service.
